Please be advised that the undersigned – Lewis N. Levy, Esq., of Levy, Stern & Ford – is general counsel to Affiliated Property Craftspersons, Local 44, IATSE (“Local 44”). Your electronic mail message of February 26, 2008, to LOCAL 44 Business Representative Ed Brown was forwarded to my office for review and appropriate response.

 

First, and as you are undoubtedly aware, Local 44 was involved in litigation with Downey Studios which settled last year. As a result of that litigation, Local 44 determined that there was no demonstrable evidence which in any way established that the premises occupied by Downey Studios, and at any time that facility has been operated as a motion picture/television production facility by, failed to meet any of the applicable governmental workplace safety regulations. Thus, Local 44 has no interest or need to communicate with you or your group regarding any other litigation or claims that are unrelated to Local 44. 

 

Second, Local 44 does not represent any employees of Kaiser or the construction companies working at or about the Kaiser facility. As such, Local 44 has no legal duty to intercede or act on behalf of those individuals.

 

In conclusion, you are to directed to send any further communications regarding this matter to my office and to cease and desist from directly communicating with Local 44, its officers and/or employees.
