Allegedly Refuses to Pay for Life Saving Supplies to Help Patient

has been filed on behalf of a 33 year old wife and mother of two young
children who lost most of her bowel as a result of alleged negligence by
doctors at Kaiser Fresno Hospital. Dr. Bruce G. Fagel filed the lawsuit October 1, 2012 in Fresno Superior Court, Case No. 12CECG03125 JH. According to court documents, at surgery, Dr. Adolfo Alvarez found that Mrs. Phillips’ bowel was twisted and necrotic. Dr. Alvarez untwisted the bowel but decided to not remove any necrotic bowel at this surgery. Over the next several weeks, Mrs. Phillips underwent 7 different abdominal surgeries to remove dead bowel, and has been left without sufficient bowel to be able to absorb food. She must now receive all of the nutrients to survive through a large intravenous line called Total Parenteral Nutrition (TPN). According to court documents, the TPN supplies cost in excess of $7,000 per month. Kaiser gave Mrs. Phillips $30,000 as an advance on any settlement, but with more than half of that amount already spent, Kaiser was asked to continue the payments for the TPN supplies, since Mrs. Phillips cannot live without this treatment. However, Kaiser has allegedly refused, prompting this lawsuit to obtain the necessary funds for her care and survival. The lawsuit was filed in Fresno Superior Court, Case No. 12CECG03125 JH.
